To John, bishop of Rochester. Mandate, as below. The recent petition of Walter COLY, layman, and Alice HONYWODE alias COLY, his wife, of the diocese of Canterbury, contained that although they formerly contracted marriage per verba legitime de presenti, and consummated it, Elena SERUAUNT of Sandwich, 1 mulier [a woman, as being opposed to being a puella or young adolescent], of the same diocese, falsely alleging that the said William had previously contracted marriage with her per similia verba, brought him and the said Alice before Thomas Winterborne, clerk, auditor-general of the court of the archbishop of Canterbury, who, wrongfully proceeding, promulgated an unjust definitive sentence in favour of the said Elena and against the said Walter, without the said Alice being otherwise summoned, 2 from which he and Alice (after it came to her knowledge) appealed to the apostolic see; that they obtained papal letters in the matter of the said appeal to the bishop of Rochester [Cal. Papal Letters, XII, p. 653], 3 and in virtue thereof caused the said Elena to be summoned before the late Thomas, bishop of Rochester; that after the said bishop had inhibited the said auditor to meddle further in the said cause, the latter caused the said Walter and Alice by a public edict posted in public places (although there was safe access to the said Walter and Alice) to be cited before him, to answer certain articles concerning contempt of his ordinary jurisdiction, and, holding them to be contumacious (which was not the fact), excommunicated them, and caused them to be publicly proclaimed as excommunicate, wherefore they have appealed to the said see, etc. At the said petition, therefore, the pope hereby orders the above bishop to summon the said Elena and others concerned, conditionally 4 absolve the said Walter and Alice from the said excommunication, hear both sides, and decide what is canonical, 5 without appeal .... censure, as in the preceding. Humilibus etc..

7 Id. Dec. (7 Dec., 1476) - St. Peter's, Rome.
To the archbishop of Canterbury. Mandate, as below. The recent petition of William GEOEI (?), layman, and Joan SYMKOK, mulier [a woman, as being opposed to being a puella or young adolescent], of his diocese, contained that although they contracted marriage per verba de presenti, after the banns had been published according to the custom of the country, and desired to solemnize it in church, and although no one opposed it, and there was no impediment, the present Rector of Falkston' [sic: Folkestone] in the said diocese, whose parishioners they are, refused to permit the marriage to be solemnized, and still refuses. The Pope, therefore, hereby orders the above Archbishop to summon the said Rector and others concerned, and if he find the facts to be as stated, to compel the said Rector by ecclesiastical censure, without appeal, to permit the said marriage to be solemnized in church, as above. - Justis supplicum.

A SAILOR'S WEDDING.
The following circumstance, however extraordinary and ridiculous it may appear, is communicated to us as an absolute fact:-
About six weeks ago a ship came into harbour at Chatham to be paid off. One of the sailors being ashore, soon prevailed on a young woman of Rochester to accept of him as a husband; and previous to returning to his ship, left money with a friend to pay for publishing the banns, and all other incidental matrimonial expenses. It was proposed that the marriage should take place on the fourth Sunday following; and on the preceeding Saturday, the honest Tar asked leave of his Captain to go on shore, which was peremtorily refused; Jack remonstrated. - "Captain," exclaimed he, "I am going to be married tomorrow." - The Captain told Jack, that the business of the ship, in Jack's department, was more urgent, and positively forbade him going on shore. Unwilling to disappoint the girl, and lose his money, Jack wisely determined to marry her by Proxy, and proposed to Will TREADAWAY, his messmate, to undertake that kind office. - "And you, Will," said he, "stay with her on shore, and when the gangway is cleared from stem to stern, I will come to you." Will goes on shore, and informing the girl of his friend's situation and proposal, she instantly consented, and was actually married to Will, as the proxy of Jack; nor did the Minister discover the mistake, till Will wrote his name in the book, TREADAWAY, instead of SALMON. The clerk cried out, "Why, you are not the man asked to church with this woman!" To which the honest tar replied, first devoting his eyes and limbs to confirm the fact, "I came here to prevent my messmate being cheated, and I only married the girl for Jack SALMON, my messmate, till he came ashore!" - And notwithstanding the altercation that took place, the happy couple retired for a few nights, till Jack came on shore, when he received his spouse from the hands of his proxy; and they are now living as much in peace and tranquillity as if they had originally tied the matrimonial knot in Propria Persona.

At Boughton Malherbe, Kent, Mr. G. MATHEWS, of Charing, to Mrs. SHARP, widow, of Egerton. The bride actually crossed the road to the bridegroom en chemise, previous to tying the nuptial knot; the act of thus receiving her being supposed to exonerate the husband from becoming liable to any debts the lady may have incurred before marriage.
[From the editor: Source: Notes & Queries, No. 166. Saturday, January 1. 1853, p. 17. "MARRIAGES EN CHEMISE. (Vol. vi., pp. 485. 561.) The popular error on the legal effect of marriage en chemise is, I think, noticed among other vulgar errors in law in a little book published some twenty years ago under the name of Westminster Hall, to which a deceased lawyer of eminence, then young at the bar, was a contributor. I believe the opinion to be still extensively prevalent, and to be probably founded, not exactly in total ignorance, but in a misconception, of the law. The text writers inform us that "the husband is liable for the wife's debts, because he acquires an absolute interest in the personal estate of the wife," etc. (Bacon's Abridgment, tit. "Baron and Feme.") Now an unlearned person, who hears this doctrine, might reasonably conclude, that if his bride has no estate at all, he will incur no liability; and the future husband, more prudent than refined, might think it as well to notify to his neighbours, by an unequivocal symbol, that he took no pecuniary benefit with his wife, and therefore expected to be free from her pecuniary burdens. In this, as in most other popular errors, there is found a substratum of reason."]
