In die no[m]i[n]e Amen 13th day of the month September Anno D[omi]ni millimo five hundred 11th and the first year of King Heny the eighth of England, I HAMOND MEXSTED of Elmsted in the County of Kent being of whole mind and perfect remembrance make and odain this my last Testament and Will in manner following that is to say:
First I bequeath my soul to Almighty God once blessed Lady Saint Mary Virgin, Saint James my patron and to all the saints of heaven, my body to be buried in the churchyard of Elmsted.
Also I bequeath to the high alter there for tithes forgotten a weder sheep.
Item to my curate therefor JOHN ABRAHAM to pray for me 6s 8d.
Also to the sacrament light there before the high alter an heifer.
Item to the light of Saint John Baptist there 4 bushels of barley.
Item to every other light in the same church a bushel barley or 4d in money.
Item to every godchild of mine a sheep.
The residue of all my goods moveable afore not bequeathed my debts paid and this my last Testament performed I give and bequeath to SAMPSON CLOOKE and EDEN his wife which SAMPSON, EDEN and THOMAS HAMOND of Elmested of this my Testament and last Will I make and ordain to be mine Executors to dispose the same my goods in deeds of charity most beneficial for my soul, the souls of my wife, my father and mother and all Christian souls. And I will the same THOMAS HAMOND have for his labour of the same my goods 3s 4d.
This is the last Will of me the foresaid HAMOND MEXSTED made the day and year aforewritten for the disposition of all my lands and tenements within the shire of Kent receyting [sic: reciting] THOMAS A COWRTE, THOMAS GOODBORNE, HENRY COLMAN and THOMAS HAMOND my feoffees of trust such it is ,
First I will that SAMPSON CLOOKE and EDEN his wife have all my lands and tenements in Elmested, Waltham and Brooke duing the time of both their lives and to the longest lived of them both that is to say my messuage or tenement at Eddyng, my messuage at Hell with all lands and pastures with all their appurtenances to the same messuages belonging And also all my lands at Brook with the appurtenances and after their deceases I will the same my messuages and lands remain to HARRY CLOOKE and JOHN CLOOKE the sons of the foresaid SAMPSON and EDEN in manner and form following that is to say,
I will that the same HARRY shall have my messuage and lands at Eddynge there lying in Elmested, Waltham and Brook to him and to his heirs male of his body lawfully begotten And for the lack of such heirs male of the body of the same HARRY begotten that then I will all the same my messuages and lands with all the appurtenances to him given remain to JOHN his brother And to the eldest heir male of his body lawfully begotten And I will that JOHN CLOOKE have my messuage at Hell and lands thereto pertaining with all their appurtenances which I purchased of Stephen Holenden with 2 acres at Thestpeyh in Dodeshamfeld and 2 acres lying at Sponge late purchased of John Mexsted to him and to his eldest heirs male of his body lawfully begotten And for lack of such heir male of the body of the said JOHN begotten then I will the same my messuage and lands afore to him given remain to HARRY his brother and to the eldest heir male of the same HARRY. And for lack of such heir male of the same HARRY and JOHN bodies lawfully begotten then I will the same my messuage and lands with all their appurtenances remain to ALICE and JOHANNE the daughters of the same SAMPSON and EDEN in manner and form following, that is to say, my messuage at Edyng with all lands thereto belonging afore given to HARRY CLOOKE shall remain to the same ALICE and to the heirs of her body lawfully begotten And the foresaid my messuage at Hell with all the lands thereto belonging afore given to JOHN CLOOKE shall remain to the same JOHANNE and to the heirs of her body lawfully begotten.
Also I will that the foresaid ALICE when she cometh to the age of 16 years shall have my tenement and lands thereto belonging at Northligh in Elmested to her and her heirs of her body lawfully begotten. And if she die without heirs of her body lawfully begotten that then I will the said tenement and lands remain to HARRY CLOOKE and to the eldest heir male of his body in manner and fom as the other lands before written be to him willed.
Also I will that the foresaid JOHANNE when she cometh to the age of 16 years shall have my tenement and lands thereto belonging lying at Whatsole in Elmested to her and her heirs lawfully begotten. And if she die without heirs of her body lawfully begotten that then I will the said tenement and lands remain to JOHN CLOOKE and to the eldest heir male of his body in manner and form as the other lands aforewritten be to him given.
And I will that the profits of the same 2 tenements and lands at Northligh and Whatsole within the time of the same 16 years be resayved [sic] yearly by the same SAMPSON and EDEN therewith to provide or cause to be provided an honest vestment for the Sundays of the poor of 66s 8d which I give to the church of Elmested and 10s of money towards a canybicloth [sic] for honour of God in the same church to be delivered.
Also I will that there be done an yearly obit during the term of 20 years fo my soul and all Christian souls in the church of Elmested aforesaid spending thereon yearly 20s a year in deeds of charity after the discretions of mine Executors.
Also I will if it happen the same HARRY, JOHN, ALICE and JOHANNE to die without heirs of their bodies lawfully begotten then I will that the same mesuages, lands and tenements with all their appurtenances and emains to the other children of the same EDEN body lawfully begotten if she any such have in manne and form as it is willed afore.
Also I will that if it happen the same HARRY, JOHN, ALICE and JOHANNE the children of SAMPSON and EDEN to die without heirs of their bodies lawfully begotten the same EDEN then being in plain life I will that the same EDEN have all those same messuages, lands and tenements with all their appurtenances shall have to her and to her heirs forevermore she paying to a priest singing in Elmested church fo my soul, my wife, father and mother and all Christian souls by the space of 2 years 20 markes.
Item I will she pay or cause to be paid of the money of the same lands so sold 20li to HAMOND MEXSTED the son of ARNOLD MEXTED.
Also I will that if the same EDEN happen to die before the same HARRY, JOHN, ALICE or JOHANNE her children that then I will the last heir of the longest liver of any of the same children shall sell all the same messuage and lands and the money thereof coming dispose in manner and form as the same EDEN afore should do if she live thereunto. And if it happen that the same EDEN, HARRY, JOHN, ALICE and JOHANNE do die none heir being alive to make sale and dispose the same lands as is aforesaid then I will that the same messuages, lands and tenements with all their apputenances be sold by mine Executors and the money thereof coming they to dispose it in manner and form as the same EDEN afore is willed to do and dispose.
