      Will of WILLIAM THOMSON, of Somersham, Huntingdon, 29 Jan 1765

      IN THE NAME OF GOD, AMEN, I WILLIAM THOMSON of Somersham, in the County of Huntingdon, me being now of sound and disposing mind, memory and understanding do make and declare this to be my last Will and Testament in manner and form following,

      First I give and bequeath to my daughter MARY TOMSON [sic] of Somersham, aforesaid, spinster, and her Executors or Administrators or assigns the sum of five hundred pounds to be paid her by my son JOHN THOMSON four years after my decease out of my several freehold and copyhold estates to be given and devised to him and which I do hereby charge with the payment thereof with interest nevertheless in the meantime and until such payment at the rate of four pounds for every [hundred] pounds by the year such interest to commence and take place [six] months after my decease and to be paid by two equal half yearly portions.

      Item, I give and bequeath unto MR. WILLIAM ROBERTS, [Barrister] at Law in Cambridge the sum of five hundred pounds to be paid him by my said son JOHN THOMSON four years after my decease out of my several freehold and copyhold estates hereinafter given and devised to him and which I do hereby charge with that payment thereof with interest nevertheless in the meantime and until such payment at the rate of four pounds for every [hundred] pounds by the year such interest to commence and take place six months after my decease and to be paid by two equal half yearly portions upon the trusts hereinafter mentioned expressed and declared of and concerning the same, that is to say,

      Upon Trust that he the said WILLIAM ROBERTS, his Executors or Administrators, do and shall when and so soon when they shall have received the said sum of five hundred pounds place the same out at interest on freehold, copyhold, leasehold securities by way of mortgage or in Government Securities and pay and apply the [....], dividends and produce thereof as the same shall from time to time arise or be received and also the interest in the said five hundred pounds during the four years above mentioned as he or they shall from time to time received the same unto my son-in-law the REVEREND CHARLES JENNER, the younger, of Huntingdon, Clerk, and his assigns for and during the term of his natural life and from and immediately after his decease then to my daughter REBECCA JENNER and her assigns for and during the term of her natural life and from and immediately after the decease of the survivor of them, the said CHARLES JENNER, the younger, and REBECCA his wife, then In Trust to pay and apply such interest and divideds as the same shall from time to time arise and be received to and for the maintenance and education of all and every the child or children, sons or daughters, of the said REBECCA JENNER, during their minoritys and upon such child or children attaining his, her or their ages of twenty-one years then to call in such trust moneys if out upon mortgage or sell and dispose of such Government or other publick securities for the best price that can be got for the same and pay and divide the same to and among such child or children equally, share and share alike, and if but one such child then to such only one provided always nevertheless that in case my said daughter, REBECCA JENNER, shall leave no such child or children at the time of her decease or in case there shall be any such and they all of them hapen to die under age, then my said Trustee, his Executors or Administrators to call in the said Trust moneys or to assign and transfer the same unto my said son, JOHN THOMSON, his Executors, Administrators and assigns.

      Item, I give and devise unto my said son, JOHN THOMSON, and to his heirs and assigns for ever all and every my freehold and copyhold messuage, lands, tenements and hereditaments whatsoever and wheresoever the same are situate lying and being with their and every of their rights, members and appurtenances subject to and charged and chargeable with the payment of the said two several legacies of five hundred pounds hereinbefore by me given and bequeathed and all other my just debts and I do likewise give and bequeath unto my said son JOHN THOMSON and to his Executors, Administrators and assigns all the rest, residue and remainder of my goods, chattels and personal estate whatsoever and wheresoever and of what nature, kind or quality soever after payment of my just debts and funeral expences hereby nominating, constituting and apointing my said son, JOHN THOMSON, sole Executor of this my last Will and Testament and revoking all former and other Wills by me at any time heretofore made and lastly my mind and will is that the said WILLIAM ROBERTS, my said Trustee, his Executors or Administrators, shall not be answerable for or liable to make good any casual or involuntary loss of the said Trust Moneys hereinbefore given him for the Trusts and purposes aforesaid nor shall he or they be answerable for the defect or insufficienty of any security whereon the said Trust Moneys shall be placed as aforesaid happening without his or their wilful default and that the said WILLIAM ROBERTS, his Executors and Administrators shall and may lawfully out of the respective Trust Moneys or any part thereof that may come into his or their hands deduct, retain and reimburse him or themselves all such costs, charges, damages and expences which he or they shall or may bear, pay, suffer, sustain or expend about the execution of the trusts hereinbefore vested in any of them and relating thereto and shall from time to time out of the said Trust Moneys be sufficiently saved harmless and indemnified therefrom.

      IN WITNESS WHEREOF I the said WILLIAM THOMSON, have to this my last Will and Testament set my hand and seal the twenty-ninth day of January in the year of our Lord one thousand, seven hundred and sixty-five.

      THIS WILL was proved at London on the fourteenth day of April in the year of our Lord one thousand, seven hundred and sixty-six before the Worshipful Goerge Harris, Doctor of Laws and Surrogate of the Right Worshipful George Hay also Doctor of Laws, Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of JOHN THOMSON, Esquire, the son of the said deceased and sole Executor named in the said Will to whom administration of all and singular the goods, chattels and credits of the said deceased was granted he having been first sworn duly to administer. Examined.
