IN THE NAME OF GOD, AMEN, I, SIMON RUCKE, of the parish of Sheldwich in the County of Kent, yeoman, being in health of body and of good remembrance by the goodness of God, doe this twentieth day of February in the year of our Lord Christ one thousand, six hundred, sixty and six, make and ordain this my present last Will and Testament in manner and form following:
First I bequeath my soul unto Almighty God my Creator, trusting to be saved by the merits of Jesus Christ my Redeemer and my body I commit to the earth from whence it was taken and to be buried in the said parish church of Sheldwich so near to the grave of my deceased father as conveniently it may be, and for my worldly goods which God hath lent me I thus dispose thereof:
First I give unto the poor of the said parish of Sheldwich the sum of twenty shillings to be paid unto them within one year after my decease.
Item I give and bequeath unto DOROTHY my loving wife all my linen or every sort and two bedsteddles now standing in the chambers over the parlor in my now dwelling house in Sheldwich aforesaid called Shephurst, and two feather beds and all other the furniture to each of them belonging and four of my chests and my great square box in my said house, and the one half of all my brass and the one half of all my pewter and all my silver plate.
Item I give and bequeath to my two younger sons, JOHN RUCKE and WILLIAM RUCKE, to each of them the sum of twenty pounds of lawful money of England to be paid unto them or to their several assigns within one year next after my decease.
Item I give unto my said son, JOHN, my bedsteddle now in the dwelling house of Jonah Mosse in the parish of Selling, in the said County, and one of my feather beds in my dwelling house called Shephurst and all other furniture fitting for _______
Item I give unto all the children of my daughter GYLES deceased, to each of them five pounds of lawful money of England to be paid unto each of them at their several ages of twenty years.
Item I give unto the three sons of my eldest son, SIMON RUCKE, to each of them five pounds of like money and to be paid unto each of them at their several ages of twenty years.
Item my will is that my said son, SIMON, shall have liberty in convenient time after my decease for himself, his heirs or assigns to come into my said dwelling house to take away that bedsteddle and the furniture thereunto belonging the which my deceased mother gave him.
Item I give and bequeath unto my youngest son, WILLIAM RUCKE, my two leases granted unto me by the president of Corpus Christi College in Oxford (that is to say) my lease of the house where I now dwell called Shephurst aforesaid and _______ with all the lands, profits and appurtenances therein granted, situate, lying and being in Sheldwich and in Selling and Chilham in the said County; and my lease of certain woodlands belonging to the said College with all the profits and benefits therein granted, lying in the said parishes or in _____or one of them; and all my right and title as a tenant to renew them at all times convenient to the use of himself and his heirs forever.
Item I give and bequeath unto my said son WILLIAM, all the residue and remainder of my household stuff and goods in my said dwelling house of what nature or kind soever which is not before in this my present last Will given nor bequeathed; and all my utensils and implements of husbandry and for husbandry uses, whether in my barns, stables, outhouses, closes, courts, yards and backsides to my said dwelling house belonging or appertaining and also four of my horses, geldings or mares, at his own choice and harnesses for them both for plough and wagon of the best I shall leave at my death; and all my wagons, ploughs, courts, harrows, rowles, fodder ingraces, gates and barrs about the lands and appurtenances belonging to Shephurst farm and the woodlands abovesaid. Moreover, I give unto my said son, WILLIAM, one hundred cops of good fodder for to help feed his horses with all if there shall be so much in my said barns or outhouses or upon the said lands reaped or unreaped, the one half to be of peat and the other half of tares; and also all the chaffe of all the corn which shall be in my said barns or on the lands belonging to the farm called Shephurst aforesaid, at the time of my death. Also my Will is that my said son, WILLIAM RUCKE, do and shall pay unto DOROTHY, my wife, or to her assigns the yearly rent or sum of twenty pounds of lawful money of England every year during her natural life and to be paid unto her quarterly at the four most usual quarters in the year, that is to say, the birth of our Saviour Christ, Annunciation of the Blessed Virgin Mary, the nativity of St. John the Baptist and St. Michael the Archangel by equal and even portions, the first payment to be made on the first of those days that shall come next after my decease and so forth from quarter to quarter during her natural life. And if the said rent or money shall be behind and unpaid either in all or in part by the space of twenty days next after any or either of those quarter days, then it shall be lawful for my said wife or her assigns to enter on or upon my said farm called Shephurst or on any part thereof and to distrain upon any goods there found and the distress or distresses so taken to lead, drive or carry away and the same to detain until all her rent or money so behind and unpaid be fully satisfied and all other charges thereupon occasioned be restored and paid, and thus to do as often as cause shall be given her during her natural life.
Item I give and bequeath unto my said son, WILLIAM RUCKE, and to his heirs forever, all those my two small messuages in Sheldwich aforesaid and now in the several occupations of Thomas Ninn and Thomas Goodwin with all the lands and the appurtenances to either of them belonging lying in Sheldwich aforesaid; and one piece or parcel of land which I purchased of Alice Hills and is now planted with fruit trees and four acres and half or thereabouts of arable land in a field called Picken Field in Sheldwich aforesaid; and one piece or parcel of land called Joan Woods which I purchased of Simon Knowlden and now in the occupation of Henry Lylly by estimation 3 acres in Sheldwich; and one parcel of land in a field called Fridhill in Sheldwich aforesaid, being arable and woodlands by estimation eleven acres; and one parcel of land arable and woodland in Sheldwich by estimation three acres lying in a field called Profitt Field; and one acre of woodland adjoining unto Stalkenwood which I had of my father Southouse, all which said several messuages, lands and every of their appurtenances I give unto my said son, WILLIAM RUCKE, and to his heirs forever, he, the said WILLIAM, his heirs and assigns paying unto my abovesaid son, JOHN RUCKE, or to his assigns the yearly rent or sum of six pounds of lawful money of England every year during the natural life of him the said JOHN, and to be paid unto him or to his assigns half yearly the one half thereof at or on the feast of the Annunciation of St. Mary the Virgin and the other half thereof at or on the feast of St. Michael the Archangel or within twenty days next after either of them and for default of payment at the said days or times it shall be lawful for him the said JOHN, his assigns, to enter into or upon the said two messuages and into or upon all the several pieces or parcels of lands hereby given and bequeath unto my son, WILLIAM, or into or upon any part thereof and to distrain and the distress or distresses so taken to lead, drive or carry away and detain until all such rent or money so behind and all charges sustained by that occasion by fully satisfied and paid.
Item my will is that my son, WILLIAM, shall pay the said yearly rent or sum of twenty pounds unto DOROTHY my wife without any deduction or abatement for or in respect of taxes, cesses or any other cause whatsoever every year during her natural life and also that he shall likewise make full payment of six pounds as abovesaid unto my son JOHN without any abatement for any cause as abovesaid every year during the natural life of the said JOHN; and also that my said son, SIMON, shall have liberty to reap, mow, cut, and carry into my barns at Shephurst all such corn and grain as shall be growing of mine upon any of the lands belonging to the said farm at the time of my death; and also to thresh it out there and to carry it away at any time until the first day of May next after such harvest.
Item I give and bequeath unto my said son, SIMON, and his heirs forever my messuage in the parish of Boughton-under-the-Blean, in the said County, with the barns, stables, outhouses, buildings, closes, yards, gardens, orchards, lands and all and every the appurtenances to the same belonging and my lease of certain lands there which I hold of John Hawkins, Esq. All being now in the occupation of JOHN RUCKE or his assigns; and my messuage in the parish of Selling and all the lands arable and woodlands and all other the appurtenances thereunto belonging and now in the occupation of CHRISTOPHER WELDISH and my small messuage, lands and the appurtenances thereunto belonging being in the said parish of Selling and County of Kent and now in the occupation of Richard Goodwin and my two messuages in the parish of Chilham and County aforesaid, and all the lands and other the appurtenances unto them or either of them belonging and now in the several occupations of John Marsh and Robert Pim or of some of their assigns and my two crofts or pieces of land which my deceased father purchased of Daniel Gyll lying in Chilham aforesaid and now in the occupation of Thomas Ninn aforesaid, all which said several messuages, lands and all and singular their and every of their appurtenances I do give and bequeath unto my son, SIMON RUCKE, and to his heirs forever but with this condition and exception, that is to say: that my said son, SIMON RUCKE, his heirs and assigns shall pay unto DOROTHY, my wife, the yearly rent or sum of ten pounds of lawful money of England every year during her natural life and to be paid unto her or to her assigns quarterly at the said days and times before in this my present Will named and appointed for her to receive her yearly rent or sum of twenty pounds of my son, WILLIAM, and in default of payment at or on the said quarter days or within twenty days next after either of them, it shall be lawful for my said wife or her assigns at all such times or at any time after, to enter into or upon the messuage, lands and appurtenances or any part thereof which is now in the occupation of the said CHRISTOPHER WELDISH in the said parish of Selling and to distrain and the distress or distresses there found and taken to lead, drive or carry away and the same to detain and ________ until all such rent or money so behind and all charges thereupon occasioned be fully satisfied and paid and thus to do as often as default of payment shall be during her natural life and also paying and allowing unto my said son, JOHN RUCKE, or to his assigns, the yearly rent or sum of fourteen pounds of like money every year during his natural life and to be paid unto him or to his assigns half yearly the one half thereof at or on the feast of the Annunciation of the Blessed Virgin Mary and the other half thereof at or on the feast of St. Michael the Archangel or within twenty days next after either of the said feasts or days of payment, and for want or in default of payment at the said days or times for payment, it shall be lawful for my said son, JOHN, or his assigns at every such default of payment as aforesaid or at any time after to enter into or upon those two messuages in Chilham aforesaid and into or upon all the lands and the appurtenances to there or either of them belonging or on any part thereof which are now in the several occupations of John Marsh and Robert Pim or their or either of their assigns and to distrain and the distress or distresses so found and taken to lead, drive or carry away and the same to detain and keep until all such rent or money so behind and all charges thereupon occasioned be fully satisfied and paid and thus to do as often as default of payment shall be during the natural life of my said son, JOHN RUCKE, and my Will further is that my said wife shall receive the full yearly rent or sum of ten pounds as above said without any deduction or abatement for or in respect of taxes of cesses or any other cause whatsoever and her first payment to be made unto her at or on the first of those quarter days that shall next come after my decease and my will also is that there by likewise no abatement at any time made unto my said son, JOHN RUCKE, either for taxes, cesses or other cause whatsoever out of his yearly rent or sum of fourteen pounds as above said; and that his first payment be made unto him or to his assigns at or on the first of those half yearly days that shall first come after my decease; and also with this further exception and condition that my said son, SIMON RUCKE, or his heirs or assigns shall truly satisfy, content and pay all the legacies which I have in this my present Will given or bequeathed at the times herein limited and appointed and discharge my funeral expenses and also that he or my said son, SIMON RUCKE, or his heirs or assigns, shall well and truly satisfy and pay all my debts of what nature soever they be whether they be secured upon part of my lands or by bonds, bills or otherwise due or whether they be partly on lands and partly on bonds, bills and partly otherwise, the twenty pounds yearly to be paid unto my wife by my son, WILLIAM RUCKE, as before is specified only excepted.
Item I do nominate, constitute and ordain my said son, SIMON RUCKE, my sole Executor of this my present last Will and Testament and the better to enable him for the payment of my said debts and legacies I do give and bequeath unto him my said son and Executor all the residue of my goods and chattels of what nature or kind soever which I have not already I this my present last Will given nor bequeathed and to the end that my said son and Executor shall truly pay and discharge all my said debts, legacies and funeral expenses as aforesaid my will is that he my said son and Executor shall give sufficient security unto my youngest son, WILLIAM RUCKE, for his performance thereof in due time that so my said son, WILLIAM, may not suffer thereby, not be disquieted nor interrupted in his possession and enjoyment of that estate which I have in this my present Will given or bequeathed unto him, but if my said son, SIMON RUCKE, shall either refuse or neglect to give such security either by bond or obligation or some other good way to the value of one thousand pounds at the least ready sealed and delivered unto my said son, WILLIAM RUCKE, or to his heirs or assigns for the purposes above said within the space of twenty days next after my decease then and in the case only my will is that my said son, SIMON, shall from that time forever be debarred of and from the Execution and Executorship of this my present last Will and Testament and that he shall not intermeddle with, not dispose of any of my goods not chattels until he have confirmed such security as above said and upon his refusing or neglecting to confirm seal and deliver unto my said son, WILLIAM, his heirs or assigns such security as above said within twenty days next after my decease that then I do nominate, constitute and ordain him my said son WILLIAM RUCKE, my sole Executor of this my present last Will and Testament for the true payment and discharging of all my said debts and legacies and my funeral expenses as above is said and to enable him thereunto I do give and bequeath unto him my said son and Executor all those several messuages, lands and every of their appurtenances the which I had before in this my present Will given and bequeathed unto my said son, SIMON, (that is to say) my messuage, lands and the appurtenances in the parish of Boughton-under-the Blean in the occupation of JOHN RUCKE together with the lease of certain lands there which I hold of John Hawkins Esq. And my two messuages lands and their several appurtenances in the several occupations of Christopher Weldish and Richard Goodwin in Selling aforesaid and my two messuages in the parish of Chilham and all the lands and the appurtenances to each of them belonging in the several occupations of John Marsh and Robert Pim and my two crofts or pieces of land which my deceased father purchased of Daniel Gyll all which said several messuages, lands and all and singular their appurtenances I do give and bequeath unto my said son, WILLIAM RUCKE, and to his heirs forever he the said WILLIAM, my Executor (in the case aforesaid) paying unto my wife the yearly rent of ten pounds during her natural life in manner and form as is before in this my present Will provided in every particular and paying unto my son JOHN RUCKE the yearly rent of fourteen pounds at the times and in manner in every particular as is before ordered and provided, and for the better enabling my said Executor to pay and discharge all my said debts and legacies I do give unto him my said son and Executor all the residue of my goods and chattels not in this my present Will before given nor bequeathed only out of the same goods and chattels I give unto my son, SIMON RUCKE, the sum of twenty pounds of lawful money of England to be paid unto him or his hires or assigns within one year after my decease. Lastly, I do revoke all former Wills and bequests and do ratify and confirm this my present last Will and Testament with my hand and seal the day and year first above written
