Will of Simon Rucke of All Saints, Canterbury 12 April 1692, proved 23 day of November 1697

IN THE NAME OF GOD, AMEN, the twelfth day of April in the third year of the reign of our Sovereign Lord and Lady William and Mary by the grace of God over England, Scotland, France and Ireland, King and Queen, defenders of the faith Anno Domini 1692, I, SIMON RUCKE, of the parish of All Saints in the City and County of Canterbury, being of sound and perfect mind and memory God be praised for the same, do make and ordain this my last Will and Testament in manner and form following, that is to say:

First I commit my soul into the hands of Almighty God my gracious and merciful Creator hoping to obtain everlasting life through the precious and meritorious death of my Lord and Saviour, Jesus Christ, and my body to the earth to be decently buried in a plain coffin by the order and appointment of my Executrix hereafter named.

Item I give and bequeath unto MARY my dear and loving wife all such household and household goods of all sorts as shall be them in my own possession or any other at the time of the death and whatsoever else can be made appear to be assets and to be found in my own custody or any others. I do also give unto MARY my wife for and in consideration of the payment of one hundred pounds which I have entered into bonds unto her brother Mr. ROBERT HEARNE to leave her at my decease which was so contracted upon our marriage and if it shall fall short in assets to be made up some other way as shall be endeavoured to be devised hereafter.

Item I do make, ordain and appoint the aforesaid MARY, my wife, sole Executrix of this my last Will and Testament and for the further settling of the rest of my temporal estate which God hath been pleased to bestow upon me I do order, give and dispose of the same in manner and form following, that is to say:

I do authorize, order and appoint my true and faithful friends Mr. WILLIAM BARROW of Borden near Tunstall and also my very loving cousin Mr. THOMAS WELDISH, Sr. of Preston-next-Faversham to be my Trustees and Overseers of this my last Will and Testament and to have the management of what I shall leave behind me in such manner as is and shall hereafter be expressed and also touching all my messuages, lands, tenements and hereditaments whatsoever, I give and dispose of them as followeth:

First, I declare my will and meaning to be that my house and tenement with the barn, stable and arable pasture and woodlands and planted lands and all other appurtenances thereunto belonging, situate, lying and being in the parishes of Chilham and Molash, in the County of Kent, and now in my own occupation and in the occupation of Richard Howell or his assign or assigns; and also one other messuage or tenement with the barn, stable, planted ground and lands thereunto belonging; and also one cherry ground, three acres and an half, more or less, situate, lying and being in the parish of Sheldwich and in the tenure and occupation of John Tailor or his assigns; and also two other messuages or tenements with the lands thereunto belonging, situate, lying and being in the parish of Halstow the Lower and now in the tenure or occupation of the widow Leger or her assigns; also one other messuage or tenement with the planted land thereunto belonging and pasture, situate, lying and being in the parish of Newington-next-Sittingbourne in the tenure or occupation of Thomas Robinson or his assigns all which my before mentioned houses, tenements, lands, woodlands and all other the before mentioned premises with the appurtenances, I will to be sold by my Trustees for the best advantage and price they can get for them and out of the monies arising by the said sale, after my debts upon mortgages on the premises or any part thereof are satisfied and paid and also so much as shall be wanting in value of my said goods and chattels to make up the said sum of one hundred pounds due unto my wife as aforesaid and also my feoffees here entrusted in the management of that concern for their care and pains I give and bequeath unto each of them the sum of forty shillings a piece, and for the remaining part what shall be raised by sale as aforesaid I give and bequeath unto my loving wife for the maintenance and bringing up of ELIZABETH RUCK and SIMON RUCK the two children I have by the aforesaid MARY RUCK and to be ordered for the best advantage for my said two children’s use, ELIZABETH and SIMON, as shall be thought fit by my Overseers in trust of this my Will as herein is expressed and not otherwise, and if it should happen that my two youngest children should die young that my desire is that if there be any considerable matter in hands that my Executors may contribute some remembrance to my first three children or to so many as shall desire kindness, which I have heard in my life time some of them have threatened to be vexatious after I am dead, but if any or either of my three children, CHARLES RUCK, ARTHUR RUCK or MARY, the wife of HENRY CARTER, of Deal, should after my decease go about or endeavour to frustrate or hinder my Executrix in the due execution of this my last Will and Testament, or should they encourage others to do the same to vex or trouble in any matter or manner as touching or concerning this my last Will and Testament, and if any of my aforesaid children shall endeavour to do or act contrary unto my said Will, then it shall and may be lawful to and for my said Executrix with the assistance of her friends in trust to demand, sue, recover of and from every one of my said children the sum of fifty pounds sterling for and in consideration of dues for what my attorneys will charge and make appear they have had of me in goods or otherwise but if no disturbance be attempted then I do hereby forgive all due to me and bar all further trouble Simon Ruck and upon ______ and fair terms my will and desire is that my three grandchildren, ARTHUR RUCK and SARAH RUCK the two children of my son CHARLES RUCK, I give and bequeath unto them ten shillings apiece.

Item I give and bequeath unto my grandchild SIMON CARTER son of my daughter MARY, the sum of ten shillings.

Also my will and mind is that if my son ARTHUR RUCK have a child living at the time of my decease and also continue until the time limited of payment of these legacies then my will and mind is the said child shall have also ten shillings and these four legacies to be paid by my Executrix within eighteen months next after my decease if there be no disturbance as before expressed. But if there be then all legacies to them and their children made void Simon Rucke.

IN WITNESS WHEREOF I the said SIMON RUCKE have hereunto set my hand and seal this twelfth day of April A.D. 1692
