Will of Simon Ruck of Bapchild, 19 August 1823.
This is the last will and testament of me SIMON RUCK, of the parish of Bapchild, in the County of Kent, yeoman, as follows, (that is to say);
I order and direct that my body be buried in the church yard of the parish of Norton in the said County of Kent and my body to the enclosed in an elm shell and then placed in a strong oak coffin.
I give and bequeath unto MARY CHAPMAN, the wife of WILLIAM CHAPMAN, of Badlesmere in the said County of Kent, yeoman, the sum of ten pounds [£10] sterling to be paid her by my Executors hereinafter named within six months next after my decease.
And I give and bequeath unto CATHERINE RUCK and JOHN RUCK, children of my late brother JOHN RUCK, deceased, the sum of two hundred pounds [£200] three per centum consols [sic, implying consolidated] now standing in my name in the books of the Governor and Company of the Bank of England to be paid, assigned and transferred unto them by my Executors hereinafter named when and so soon as they shall attain their age and ages of twenty-one [21] years as tenants in common and not as joint tenants, with the dividends which shall in the meantime accrue thereon. And I declare that if I shall not to die possessed of the stock transferable at the Bank of England above specifically bequeathed the said specific legacy of stock above bequeathed or the deficiency thereof shall be made good out of my other personal estate.
And I give and devise all that my messuage or tenement, garden and premises with their appurtenances wherein I now reside situate at Bapchild aforesaid and all other my real estate unto my nephews and nieces BEDDINGFIELD HENRY LEESE, JOHN LEESE, MARTHA LEESE and JOANNA LEESE, all of Stubbington in the parish of Norton aforesaid and their heirs and assigns forever as tenants in common and not as joint tenants.
And as to all the rest, residue and remainder of my personal estate whatsoever and wheresoever I give and bequeath the same unto JOHN NEAME of Selling in the County of Kent, Gentleman, and the said BEDDINGFIELD HENRY LEESE, their Executors, Administrators and assigns upon trust that they the said Trustees or the survivor of them or the Executors, Administrators or assigns of such survivor do and shall with all convenient speed after my decease call in and convert into money all my said personal estate or so much thereof as shall not consist of money and I do hereby declare that they the said trustees or trustee for the time being shall stand and be possessed of such part of my said personal estate as shall consist of money and of the monies to arise from such other part of my said personal estate as I have hereinbefore directed to be converted into money upon trust that they the said trustees or trustee for the time being do and shall with and out of the said monies pay, satisfy and discharge all my just debts, funeral and testamentary expenses and the legacies by me hereinbefore given and bequeathed and do and shall stand possessed of the residue of the said monies which shall remain after answering the purposes aforesaid in trust for the said HENRY BEDDINGFIELD LEESE, JOHN LEESE, MARTHA LEESE, JOANNA LEESE, CATHARINE RUCK and JOHN RUCK, their several and respective Executors, Administrators and assigns to be paid them when and so soon as they attain the age of twenty-one [21] years as tenants in common and not as joint tenants.
And I do hereby declare that if any or either of my said Legatees shall depart this life under the age of twenty-one [21] years then as well the original share or shares of him, her or them so dying as the share or shares which by virtue of this present clause shall have survived or accrued to him, her or them shall from time to time go, accrue and belong to the survivors and survivor and others and other of them, if more than one, in equal shares as tenants in common.
And I declare and direct that if the said JOHN NEAME and BEDDINGFIELD HENRY LEESE or either of them shall die or refuse or decline to act in the trusts of this my Will then a new trustee or trustees may be appointed by the trustees or trustee so declining to act, or the Executors or Administrators of such of them as shall so die, and the said estate monies and premises shall in that case be conveyed and assigned so as to be vested in such new and surviving continuing trustees or trustee or in case such new trustees wholly as the case may happen upon the same trusts and with the same powers as are hereinbefore mentioned and declared and so from time to time as often as that case shall happen and I appoint the said JOHN NEAME and BEDDINGFIELD HENRY LEESE Executors of this my Will and declare that they and the trustees or trustee for the time being thereof shall not be answerable one for another and by no means for involuntary losses and that they shall be allowed and may retain all their costs, charges, damages and expenses to be occasioned by the due execution of the trusts hereby in them reposed.
And I revoke all my former wills.
IN WITNESS WHEREOF I, the said SIMON RUCK, the Testator have to this my last Will and Testament contained in two sheets of paper set and affixed my hand and seal to the last sheet thereof and subscribed my name at the bottom of the other sheet thereof this nineteenth day of August in the year for Lord one thousand eight hundred and twenty-three.

SIMON RUCK, the Testator to be his last Will and
Testament in the presence of us the witnesses hereunder
written who have at his request and in his presence and in Simon Ruck
the presence of each other hereunto subscribed our names
as witnesses to the due execution of this his said last will
and Testament.

PROVED at London the 4th January 1827 before the Judge by the oath of BEDDINGFIELD HENRY LEESE, the nephew one of the Executors to whom administration was granted having been first sworn by commission duly to administer and power reserved to JOHN NEAME the other Executor.
