Archdeaconry Court of Canterbury, Will of Thomas RUCK, of Elham, 16 Nov 1699

IN THE NAME OF GOD, AMEN, I, THOMAS RUCK, of Elham in the County of Kent, yeoman, being aged and often times indisposed in health but at present of sound and perfect mind and memory (God be praised) do make and ordain this my Last Will and Testament in manner and form following:

Inprimus: I resign my soul into the hands of almighty God my merciful creator hoping for salvation only by the merits of my Lord and Saviour Jesus Christ and my body I commit to the earth to be decently buried at the discretion of my Executors hereafter named.

Item, I give and bequeath unto my son DANIEL RUCK my four wagon horses with their harnesses, wagon, plough, harrows and implement of me standing now in his possession and which I have before given him by word of mouth and now to confirm the same by this my Will. AND WHEREAS my said son DANIEL RUCK now stands justly indebted unto me in the full sum of eighteen pounds of lawful money of England being for wheat sown upon the lands of the farm wherein he now lives, hogs bought and money had of me which said sum of eighteen pounds I give unto my said son DANIEL RUCK as also the further sum of twelve pounds of lawful money of England to make up the aforesaid sum of eighteen pounds, the full sum of thirty pounds and which said sum of twelve pounds I do hereby will and order shall be well and fully paid by my said Executors unto my said son DANIEL RUCK within three months next after my decease.

Item, I give and bequeath unto my son JOHN RUCK the sum of twenty pounds of lawful money of England to be paid unto him by my said Executors likewise within three months next after my decease. And [it appears that there is text missing at this point as this microfilmed original text was sent to me by another researcher but does appear to be complete] every part thereof shall be equally divided between my four sons (vizt.) my aforesaid two sons DANIEL RUCK and JOHN RUCK and my two other sons and Executors herein named, RICHARD RUCK and THOMAS RUCK, share and share alike, within one month next after my decease and as for all the rest and residue of my goods, chattels, stock and crop not hereinbefore bequeathed, together with my ready money, bills, bonds, mortgages and personal estate whatsoever, my debts, legacies and funeral expenses being first paid and discharged, I give and devise the same and every part thereof unto my said two sons, RICHARD and THOMAS RUCK, their Executors and administrators equally to be divided between my said two sons RICHARD and THOMAS, their Executors and administrators and I do hereby make and order my said two sons, RICHARD RUCK and THOMAS RUCK Executors of this my last Will and Testament desiring them to see all things performed according to this my Will, revoking and making void all former Wills by me made and confirming this and none other to be my last Will and Testament.

And as touching and concerning all that messuage or tenement and six perches of land more or less with the appurtenances thereunto belonging situate lying and being in Elham aforesaid, at or near unto a certain place there called the Butts and now in the occupation of Thomas Winckells, I give and bequeath the same and every part and parcel thereof unto my aforesaid son, THOMAS RUCK one of my Executors and unto his heirs and assigns forever.

I witness whereof to this my present last Will and Testament, I the said THOMAS RUCK have hereunto set my hand and seal the sixteenth day of November in the eleventh year of the reign of our Sovereign Lord William the Third, now King of England, Anno Domini 1699.
