IN THE NAME OF GOD AMEN, I, RICHARD RUCK, of Elham, in the County of Kent, Victualler, being weak in body but of sound and perfect mind and memory (God be praised) do make and ordain this my last Will and Testament in manner and form following,
Inprimis, I resign my Soul into the hands of Almighty God my merciful creator hoping for salvation only by the merits of my Lord and Saviour Jesus Christ, and my body I commit to the Earth to be decently buried at the discretion of my Executors hereafter named,
Item, I give and bequeath unto my loving wife, JANE, all and singular my household stuff being linen, plate and pewter now remaining and being or which at the time of my death shall remain and be in the house wherein I now dwell situate in Elham aforesaid,
And also I give and bequeath unto my said loving wife, JANE, for and during her natural life and no longer in lieu of her dower which she may in any manner otherwise claim or challenge out of my estate one annuity or yearly rent charge of seven pounds of lawful money of England to be issuing and going out and to be received and taken out of all that my messuage or tenement commonly called or known by the name of Maxted together with the outhouses, barns, stables, courts, yards and one hundred acres of land more or less to the same belonging with all and singular the appurtenances situate lying and being in the several parishes of Elmsted and Stowting or in one of them in the said County of Kent and now in the occupation of Henry Burch or of his assigns and which I late purchased of Mr. Samuel DeSantliuns to be paid unto my said wife, JANE, or her assigns at the feast of the Annunciation of the Blessed Virgin Mary, and at Michael the Archangel by even and equal portions, the first payment thereof to be made at the first of the feasts which shall next happen after my decease, and if it shall happen the said yearly rent charge of seven pounds to be unpaid by the space of one and twenty days next after either of the said feast days in which the same ought to be paid as aforesaid then I give and grant unto my said wife and her assigns full power and authority to enter into the aforesaid messuage or tenement land and premises hereinbefore chargeable with the aforesaid yearly rent or sum of seven pounds by the year and to distrain for the same and the distress and distresses then taken to impound, detain and keep until she be fully satisfied and paid the said annuity and all charge in and about the distress and distresses,
Item, I give and bequeath unto my eldest daughter, ELIZABETH the wife of JAMES CULLING, the sum of forty pounds of lawful money of England to be paid unto her by my Executors hereafter named within one year next after my decease,
Item, I give and bequeath unto my two younger daughters, JANE RUCK and MARY RUCK, the sum of fourscore pounds apiece of lawful money of England to be paid unto each of them as they shall attain their several ages of twenty years or days of marriage which shall first next happen after my decease by my said Executors and in the meantime until the portions of my said two daughters, JANE and MARY, shall become due and payable unto them as aforesaid I do hereby will and order that my said Executors shall pay interest for their several portions after the rate of five percent for and towards their maintenance and bring up,
Item, I give and bequeath unto my youngest son, RICHARD RUCK, all that my messuage or tenement and garden with the appurtenances situate lying and being in Elham aforesaid in the said County of Kent and now in the occupation of John Austen or of his assigns and which I late purchased of William Norton to have and to hold to him my said son RICHARD RUCK his heirs and assigns forever as also I give and bequeath unto my said son, RICHARD RUCK, the sum of one hundred and fifty pounds of lawful money of England to be paid unto him by my said Executors when he shall attain his age of one and twenty years, in the meantime until the portion hereinbefore bequeathed unto my said son, RICHARD, shall become due and payable unto him as aforesaid I do likewise hereby will and order that my said Executor shall allow and pay unto my said son, RICHARD, or to such person or persons as shall have the education and bringing of him up the yearly sum of eight pounds of lawful money of England by even and equal portions half yearly to be paid, and I do hereby appoint my dearly beloved wife, JANE, to be guardian to my three children, JANE RUCK, MARY RUCK and RICHARD RUCK, during their several minorities, desiring my said wife to order and educate them as to her wisdom shall seem most convenient for them,
And of this my last Will and Testament I do constitute and appoint my two sons, THOMAS RUCK and JOHN RUCK, to be my Executors of this my last Will and Testament to whom after all my debts, legacies and charges of proving of this my Will and funeral expenses being discharged I give and bequeath all my brewing vessels, goods, chattels, bills, bones, mortgages and personal estate whatsoever (except what I have hereinbefore bequeathed unto my said wife) to be equally divided between them,
And I do hereby desire and appoint my loving brother, THOMAS RUCK, of Elham aforesaid, yeoman, to be overseer of this my Will and to be and doing and assisting to my said Executors in the execution thereof at all times when they shall desire the same, and if he shall at any time take any journey and what business he shall do concerning the execution of this my Will upon the desire of my Executors that they do allow him satisfaction for the same.
This is the last Will and Testament of me the said RICHARD RUCK made and declared the day and year hereafter named and as touching and concerning the disposition of all that aforesaid messuage or tenement lands and premises out of which the aforesaid annuity or yearly rent charge of seven pounds per annum is hereinbefore bequeathed unto my wife and mentioned to be situate lying and being in Elmsted and Stowting aforesaid I give and bequeath the same and every part and parcel thereof with the appurtenances unto my said two sons and Executors THOMAS RUCK and JOHN RUCK and their heirs and assigns forever equally to be divided between them subject nevertheless to the aforesaid annuity herein before bequeathed unto my wife, and if it shall fall out that my personal estate shall not be sufficient for the paying and discharging of all my children then several portions or legacies hereinbefore bequeathed unto them that then my Will and mind is and I do hereby will and order my said two sons and Executors, THOMAS RUCK and JOHN RUCK, to make and pay the same out of my aforesaid messuage or tenement lands and premises to be situate lying and being in Elmsted and Stowting aforesaid hereinbefore bequeathed unto them, And I do hereby charge the same with the payment thereof.
In witness whereof I the said RICHARD RUCK to this my last Will and Testament contained in two sheets of paper have to each sheet subscribed my name and set my seal the fourth day of January in the first year of the reign of our Sovereign Lady Anne by the grace of God of England, Scotland, France and Ireland, Queen, Defender of the Faith, etc. Anno Domini 1704
