      Abstract of Austen Family Wills from Arthur Hussey’s Manuscripts

      Will of Walter AUSTEN of Wye, 24 October 1473

      Walter AUSTYN of Wye, 24 October 1473.
      Buried in churchyard of St Gregory of Wye.
      High altar 3s.4d. Light of Holy Cross, St John 12d. each. Parish chaplain 8d, parish clerk 4d.
      Repair of road between the gate of my messuage and Harfeldgate 13s.4d.
      Son Simon when 16 four dyker [1 dyker = 10 skins, i.e. 40 skins] of red leather of which two dyker [20 skins] of sole-leather and two of overleather, also two cows, two young bullocks, two vitulos (calves).
      Residue of goods after debts paid to wife Dionise, who with Thomas AUSTYN my son my Ex’ors to dispose for my soul.
      Wife occupy and have profits from my messuage and ten acres of land for life, after her death Joane COOKE my daughter five rods of land in Chambre Street and to her heirs for ever.
      Wife have profits of half my other lands, tenements until son Simon is 16, then to Simon; and to son Thomas Austyn other half of lands, etc.
      If either son die without lawful issue his part to the other.

      High altar 20d. Light of Holy Cross, B.Mary 12d. each, St Clement, St Christopher 4d. each.
      Residue to wife Joan, who with John SAUNDER my Ex’ors to dispose for my soul.
      Wife Jone occupy my lands until John and Simond my sons come of age, paying to Joane ASTYN my mother 20s. yearly as by Will of my father.
      When sons of age to have lands equally, paying to Joane my wife 20s. yearly, and same to Joane my mother. Also sons pay to Thomasine my daughter at her marriage 40s.
      If both sons die without lawful issue, then lands to daughter Thomasine and her lawful issue, she paying my mother and my wife their dowers as before. If daughter die without lawful issue then lands be sold by Ex’ors, money disposed in three parts (1) to reparation of Wye church, (2) to a priest to sing for our souls in the church, the priest to be bounden to the quire of the College only on Sundays and Holy days as the law wills, (3) to repair of bad roads in Wye parish.

      But the court-lodge and demesne lands, containing about seven hundred acres, are demised by them on a beneficial lease. Sir Henry Oxenden, bart. of Brome, is the present lessee of them.       IN THE NAME OF GOD, AMEN, I, ROBERT AUSTEN of the parish of Adisham sick in body but perfect in memory do make this my testament and last Will,

      First, I bequeath my soul to almighty God the father and to his son Jesus Christ, through the merits of whose passion I do perfectly believe to have my salvation, And I will my body to be buried in the church or churchyard of Adisham at the discretion of mine Executors.

      Also I bequeath to the buying of a cope for the church aforesaid 33 shillings 4 pence.

      Also I will that my Executors do calymer unto the church 20 shillings.

      Also I bequeath to ELIZABETH MORLES at the day of her marriage 3 pounds, 6 shillings, 8 pence.

      Also I will to KATHERINE MORLES at the day of her marriage 20 shillings.

      Also I bequeath to ELIZABETH beforenamed 2 pair of sheets and one coverlet at the same day or 5 shillings to buy a coverlet and one bullocke, 3 platters and one honest candlestick.

      Item, I bequeath to KATHERYNE her sister 2 pair of sheets and one coverlet or 5 shillings, 3 platters and one honest candlestick.

      Item, I bequeath to each of them one gown of 2 yards and 3 quarters a piece, price the yard 5 shillings, to be delivered against their marriage day by the overseer of my Will with the premises, And if it happen them to die before the other and before any of them be married then I will the longer liver to have the 5 yardes and a half.

      Item, I bequeath to THOMAS AUSTEN my eldest son my 2 tenements with the lands unto them belonging from the parsonage unto Richardes and so up to Frythe.

      Also I bequeath to RICHARD AUSTEN my second son my tenements with the appurtenances called Laddes and also Richardes.

      Also I bequeath to VALENTYNE AUSTEN my third son my tenement with the appurtenances and lands lying and being in the parish of Bridge with my tenement and the appurtenances and lands being at Bledding.

      Item, I bequeath to JOHN AUSTEN my youngest son my tenement in the Dane that he dwelleth in, with my tenement called Bakers with their appurtenances and lands belonging unto them except the close at the Horse Tree Gate. So that if he die without issue lawfully begotten then I will the same tenements and lands to remain to his brothers that then shall be alive and to be equally divided amongst them.

      Item, I bequeath to WILLIAM AUSTEN the son of RICHARD AUSTEN my son my tenement that lieth by the Sole, so that the poor woman that now liveth there have a chamber there during her life paying 2 pence by the year towards the reparations thereof.

      Item, I bequeath to RICHARD AUSTEN my son my tenement with the appurtenances commonly called the Ailehouse.

      Item, I bequeath to my 4 sons, THOMAS, RICHARD, VALENTYNE and JOHN my marshes lying and being in the parish of Wichambreaux equally to be divided amongst them.

      Also I will that 20 shillings be given to poor people in alms at the day of my burial and 20 shillings at my month's mind, and 20 shillings at my twelve month's mind.

      Also I will that 20 priests do say mass and pray for my soul at the day of my burial and each of them to have for their labour 6 pence a piece.

      Item, I will likewise at my month's mind and so at my 12 month's mind.

      Item, I will that Mother KEMPE mother-in-law to my son JOHN have 2 acres of wheat and 2 of barley, which I will to be delivered out of the field.

      Also I will that my son RICHARD have my corn in the barn of seed, wheat 30 quarters paying for every quarter 12 shillings.

      And I will that he have of seed barley 60 quarters paying for them 13 pounds.

      Item, I will the corn to pay this year's farm that is past be taken out of the grain that is in my barn.

      Item, I bequeath to RICHARD AUSTEN the son of THOMAS AUSTEN my son my tenement which did late purchase of Mr. Isake in the Dane.

      Item, I bequeath to JOHN AUSTEN my youngenst son 6 acres of ground lying before Ratling Bank, the highway going through it.

      Item, I bequeath to NYCHOLAS FARMAN 2 yards of broad cloth price the yard 3 shillings and in money 20 shillings.

      Item, I bequeath to PEKE my servant so much cloth of like price and 13 shillings 4 pence in money.

      Item, I bequeath to each of my godchildren one sheep commonly called an ewe.

      Item, I bequeath to JOHN JOHNSON of Goodnestone 13 shillings 4 pence.

      Item, I will that my son RICHARD have the awpieng [use] of such horse this year as be mine to till the ground to the farm. And I will that he shall have of my moveables by price 40 pounds.

      Item, I bequeath to MARGERY my servant 4 bushels of barley and to my godson ROBERT GODFREY as much.

      Item, I bequeath to my son RICHARD 8 beasts commonly called kyne [cow] and I will my son VALENTYNE have all the residue of my kyne, except one bullock or a heiffer.

      Also I will that my son RICHARD have 8 horses 6 of the best and the fillar with one of the other sort paying for them 12 pounds, and the other to be equally amongst my 4 sons.

      Item, I will he have all carts, ploughs and courts except one pair of cart rodes [wheels] which I give to my son JOHN. And I will that JOHN AUSTEN my son have 33 shillings 4 pence to buy a pair of cart wheels.

      Item, I bequeath to RICHARD AUSTEN my son one silver piece partial gilt and 2 spoons of silver.

      Item, I will to THOMAS my son 2 spoons of silver.

      Item, I will to VALENTYNE my son 3 spoons of silver, And to JOHN my son one mazer.

      Item, I will to my son RICHARD one hundred of sheep. To my son THOMAS 60 sheep.

      To my son VALENTYNE one hundred sheep And to my son JOHN one hundred sheep.

      Also, I bequeath to my son RICHARD 3 parts of my houshold stuff and the 3 other parts to divide betwixt my other 3 sons THOMAS, VALENTYNE and JOHN.

      Also, I will that my son RICHARD have of such grain as is in my barn 40 quarters of barley to make malt and 16 of wheat and 16 of barley to keep his house this year without payment for it.

      Also, I bequeath to VALENTYNE AUSTEN my son 4 weaning pigs and to my son JOHN so many.

      Also, I bequeath to MARMADUKE FAREMAN a coat cloth, a hose cloth price 2 shillings and a doublet.

      Item, I bequeath to BIRFELDE one hose cloth price 2 shillings.

      Item, I will that if PAYNE be contented as I and he were agreed that then he have 10 pounds that is due unto me to be paid for a tenement sold at Bridge and the other 10 pounds to be raised of my moveables, And my Executors to pay the said 10 pounds. And if PAYNE be not so contented according to the agreement between us then I will that my son RICHARD have the same 20 pounds. Also I give to my son RICHARD all my podware and hogs freely.

      Also, I give to him the croft at the horse Tree Gate.

      Also, I bequeath to ROBERT AUSTEN the son of THOMAS AUSTEN my son my tenement there as the tyler dwelleth which is with needle work.

      Also, I will and give to JOHN AUSTEN my son [to JOHN AUSTEN my son = appears to be a repeated sequence] 10 seames of barley to be paid by his other 3 brothers indifferently.

      Also, I will that none of my Executors or 4 sons do claim or require any parcel or sum of money that I have paid for them or have lent unto them as debt at any time but that I have freely forgiven such sum or sums of money unto them forever.

      Also, I will that JOHN JONSON be overseer of this my last Will, by whom I will and require my 4 sons THOMAS, RICHARD, VALENTYNE and JOHN whom I do ordain to be my Executors to be ordered and ruled in all my bequeaths and other unbequeathes according to this my last Will.

      And if any of them do strive one with another or against another for any parcel or whole of moveables or unmoveables bequeathed unto him or them and will not be ordered by the overseer according and not contrary to my Will then I will that he or they that shall so strive and will not be ordered as is aforesaid shall be void and without the moveables and unmoveables before bequeathed unto him or them by Will and to be amongst the other that will be ordered and contented according to my Will.

      And then I will the residue of my goods as well moveable as unmoveable my debts and bequeaths paid to be at the disposition to my sons that will be honestly ordered according to this my last Will and Testament made in the 36th year of our sovereign Lord King Henry the Eighth and in the month of November the 23rd day.
