Will of Edmund Cloake, of Elmsted, Kent

In the name of God Amen the thirteenth day of October 1612 I Edmund Cloake of the parish of Elmsted in the County of Kent yeoman being in good and perfect remembrance thanks be unto almighty God do make and ordain this my last will and testament in manner and form following that is to say
First I bequeath my soul unto almighty God hoping and assuredly to be leaving? to have remission of all my sins by the precious death of his dearly beloved son Jesus Christ my only saviour and redeemer and my body to be buried where it shall seem fit to my executor hereafter in this my said Will named
And as touching my worldly goods whereof it hath pleased god to make me an unworthy steward
First I give to Julian my wife for her maintenance fifteen pounds a year during her natural life out of all the lands whereof I shall die seized to be paid her at the four usual feasts or times of the year that is to say at the feast of St Michael the Archangel the nativity of our lord the annunciation of our blessed Lady the Virgin and at the feast of St John Baptist by even portions to be paid the first payment thereof to be made in and upon the first of the said feast days which shall come next after my decease and also my will is that if the said annuity of fifteen pounds shall at any of the said feasts be unpaid in all or in part that then it shall & lawful for the said Julian to distrain in all my lands to my son Samuel willed for the said annuity and the distress so taken to keep until she be satisfied of the whole arrears and all the costs and charges thereby sustained
Item and my will and meaning is that Julian my wife shall have in my house at Denne where I now dwell the chamber over the Kitchen to dwell in during the time of her natural life with free ingress egress and egress unto the same at all time and times convenient and free ...... for her and her servant to come to the fire in the hall or kitchen to dress for meat and drink to her and as often as she shall thereto have further I give unto Julian my wife use of the chamber with one feather bed and feather bolster my best covering and two blankets and one pillow for herself.
Item I give unto Julian my wife one truckle bedstead with flock bed and bolster one blanket and one covering for her maid.
Item I give unto my wife Julian two loads of wood yearly to burn in the chamber and yearly to be brought home to the so said hearth by my executor hereinafter named and one cow to be kept both winter and summer by the said executor during her natural life.
Lastly I give unto Julian my wife the half of my pewter the half of all my brass and the half of my linen provided always that if the said Julian my wife shall challenge any demand of any lands whereof I now am seized or here before have been seized that then she shall lose the use to benefit of this my will.
Item I give unto Henry Cloke five shillings to be paid him within one year of my decease
Item I give unto Edmund Cloke my youngest son three score pounds to be paid unto him within two years after my decease
Item I give unto my daughter Elizabeth now the wife of John Collard five shillings
Item I give unto my daughter Alice now the wife of George Cross ten shillings
Item I give unto Mary my daughter the sum of one hundred pounds to be paid unto her within six months after my decease
Item I give unto Jane Cloke my youngest daughter the sum of one hundred pounds to be paid unto her within two years after my decease
The residue of all my not before bequeathed I give unto Samuel Cloke my son whom I do make my sole executor of this my will and testament of me the aforesaid Edmund Cloke.
Concerning the disposition of all my lands and tenements in Elmsted or elsewhere within this ...... of England all which my lands I give unto my son Samuel and his heirs forever provided always and my will is that if my son Samuel shall fail to make payment of the hundred pounds formerly in my will given unto Mary Cloke my daughter at the time before mentioned in my will that then my said daughter Mary shall enter upon one parcel of my land called Eastcourt? containing by estimation eighteen acres and have the said lands to her and her heirs forever in lieu of the hundred pound in my will formerly given her And likewise provided and my will is that if my son Samuel shall fail to make payment of the hundred pounds formerly in my will given unto Jane Cloke my youngest daughter at the time aforementioned in my will that then my said daughter Jane shall enter upon twenty acres of my land in Deane Valley lying towards the South from the head of the upper valley to the Knockell wood and have the said twenty acres to her heirs forever in lieu of the hundred pounds in my will formerly given unto her and likewise provided and my will is that if my son Samuel shall fail to make payment of the three score pounds formerly in my will given unto Edward Cloke my youngest son at the time aforementioned in my will that then my said son Edward shall enter upon one parcel of my arable land called the Park containing by estimation eighteen acres and have the said parcel of land to him and his heirs for ever in lieu of the three score pounds in my will formerly given unto him
In witness whereof to this my present will I set my hand and seal Edward Cloke his mark Witnesses thereunto

And then the said Edmund further willed that Julian his wife shall have the fruit of one row of apple trees next the highway in his Orchard at Deane during her usual life and also that the said Julian shall have so much land fit for hemp by the assignment? of Samuel Cloke her son being parcel of the Manor of Deane as may hereby be sufficient to be sown with a tovet of hemp seed Witness hereunto John Honywood
